Exonerated Milwaukee man compensated for imprisonment

by Administrator 20. May 2010 02:50

A man who was jailed for 13 years for murder will be paid $25,000 by the state after he was exonerated of his crime.

The man was convicted in a 1995 murder in which two other men implicated him in the crime, but DNA evidence has overturned that conviction. Instead, an accused serial killer was linked through this evidence to the murder.

The state claims board of Wisconsin is rewarding the maximum amount of $25,000 for his 13 years of wrongful imprisonment, which amounts to less than $2,000 for every year spent behind bars. The wrongly convicted man and his lawyer do not feel that this sum, even though a maximum reward, is sufficient as compensation for 13 years of prison. The Wisconsin Innocence Project agrees. They are working to pressure lawmakers to raise the current ceiling for wrongful imprisonment compensation, hopefully providing a better monetary basis to allow innocent prisoners to rebuild their lives.

Currently, a federal lawsuit has been filed against the city of Milwaukee, and the police department in particular. If he wins, he would be additionally compensated for the alleged police coercion of the two men who originally confessed and implicated him in the crime.

If you believe that you have been wrongly convicted of a crime you didn't commit, you may be able to repeal your charges. The first step in the process is knowing your rights. Contact Kohler & Hart, LLP, by calling 888-565-7597, and let the Milwaukee criminal appeals attorneys help you today.

Conviction overturned in gun possession case

by Administrator 26. April 2010 04:42

The 7th U.S. Circuit Court of Appeals recently overturned a conviction when the jury found a 52-year-old Wisconsin man guilty of knowingly possessing an unregistered rifle and silencer. The federal appeals court said the jury let character evidence and prejudicial error interfere with its decision. The man could be considered eccentric because of some strange items in and around his house, the court said, but they could find no actual evidence of criminal intent.

The gun in question had a broken stock and a cut-off barrel. A man testified that the gun broke after he hit a raccoon over the head while hunting. The man in question said he had inherited the gun, and he thought it was a pistol. The man said the silencer was an oil filter he had fashioned into a flash suppressor for his shotgun.

Baby Left in Van Dies

by Administrator 10. April 2009 02:40

A day care van driver has been charged in the death of a child left in a vehicle.

The child was picked up in the morning at the family home.  One of the parents of the child was outside and watched the four-month old baby get in the car,  which would be the last time to see the child alive.

The baby was left in the car from 8:30 a.m. , and discovered dead after 2:00 p.m.  Questions are being asked, about why the child was not discovered earlier?

Charges have been placed against one of the day care workers.

Court of Appeals Upholds Murder Sentence

by Administrator 15. January 2009 08:01
In 1996, a man was convicted of murdering his wife and decapitating her in order to make identification more difficult. The man recently appealed his 60 year sentence on grounds that the state allowed false testimony and that the sentence was inappropriate and unconstitutional. The man failed to provide any evidence that there was any incidence of perjury in his original trial. The judges also pointed out that the crime was "particularly heinous" and therefore deserving of the punishment. The man handled his own appeal without legal aid. If you or someone you know is facing criminal charges, or appealing, contact the Milwaukee criminal defense lawyers of Kohler & Hart, LLP at 888-565-7597.

DNA Evidence Points to Someone Else

by Administrator 13. January 2009 05:01

A Milwaukee man has been serving a life sentence since he was convicted for the murder of a 16 year old girl in 1995. However, DNA evidence has recently granted him his freedom.

Tests have shown that the DNA of an unknown man was found on the girl as well as two other murder victims around the same time. Because of this, a state appeals court has granted a new trial. A finding of guilt may not be permanent. If you or someone you know is facing criminal charges, contact the Milwaukee criminal lawyers of Kohler & Hart, LLP at 888-565-7597.
